"Protection of Freedom of Economic Activity in Lithuania and Germany" book presentation
On 13 November 2024, The Supreme Administrative Court of Lithuania (SACL) hosted the presentation of the book "Protection of Freedom of Economic Activity in Lithuania and Germany", co-edited by SACL Judge Egidijus Šileikis.
The scientific editors of the book, Prof. Dr. Egidijus Šileikis and Prof. Dr. Jurgita Paužaitė-Kulvinskienė, presented the issues addressed in the book, analysing various aspects of regulation and restriction of interdisciplinary entrepreneurial initiatives, such as: economic-legal regulation and supervision of economic activity, including the control and administrative sanctioning by the Court of Justice of the European Union; implementation of the principle of sustainable development in the fields of energy, water resources and spatial planning; and regulated markets, including the alcohol and the pharmaceutical sectors. Judge Rasa Ragulskytė-Markovienė of the Supreme Administrative Court of Lithuania also presented her research in the book.
According to the authors, research on the implementation of the freedom to operate poses a number of challenges, not only legal, but also economic, health, environmental and other public goods protection challenges. In recent years, not only has the jurisprudential practice in this category of disputes intensified, but also scholars have begun to focus more intensively on the freedom of economic activity and the limits of its implementation. This book is characterised by a very broad research context, with different areas of economic activity and a multi-institutional oversight mechanism under different special legal regimes. The articles in this book are particularly relevant in the European context, and each author has contributed to the theoretical and practical European discourse on the implementation of economic activities according to his or her own perception and approach.
According to Dr. Haroldas Šinkūnas, Dean of the Faculty of Law of Vilnius University, the book is the result of close cooperation between German and Lithuanian scholars and the basis for the development of our legal culture, and he emphasised the importance of citing the doctrine in court decisions.
